Welcome to the NeuPractix platform and our applications (EyeFocus, ReactionFocus, SenseFocus, EaseFocus, and MoveFocus; collectively, the “Applications” or the “Platform”). Use of the Platform, including the free assessment stage and the paid training stage, is subject to your full and unconditional agreement to the terms set out below. If you do not agree to any part of these terms, you must immediately discontinue use of the Platform.
1. No Medical Claims & General Wellness Product Statement
- NeuPractix applications are a digital platform intended solely for neuroplasticity-based training, and for supporting focus, coordination, sensory regulation, and general personal wellness (a “General Wellness Product”).
- The Platform is not a medical application, is not defined or registered as a Medical Device, and is not intended to diagnose, cure, prevent, improve, or treat any disease, physical or neurological impairment, or medical condition.
- All information, data, scores, and metrics displayed during the assessment or training stages constitute an abstract, statistical cognitive-functional indication only. They must not, under any circumstances, be regarded as medical opinion, clinical diagnosis, or a substitute for a professional examination.
2. Duty to Seek Professional Consultation
- Use of the Platform does not, in any way, replace examination, consultation, diagnosis, or follow-up by a licensed physician, physiotherapist, audiologist, optometrist, or other qualified professional, as relevant.
- If you experience chronic difficulties, unusual symptoms, pain, dizziness, blurred vision, or any other physical, sensory, or cognitive symptom, you must seek immediate attention from a qualified professional. Never disregard professional medical advice or delay seeking treatment because of information or results obtained through the Platform.
- Do not stop, change, or delay the use of any existing aids, devices, or prescribed medication based on your use of the Platform.
3. 🚨 Important Safety Warning: Epilepsy & Photosensitivity
- Some of the Platform's applications use visual elements that include flashes, frequent lighting changes, and rapid refresh rates (visual stimulation / flickering) as part of the dynamic stimulus logic.
- Use of these applications (both the assessment and training stages) is strictly prohibited for:
- Individuals diagnosed with epilepsy or photosensitive epilepsy.
- Individuals with a personal or family history of epileptic symptoms, seizures, fainting, or loss of consciousness triggered by flashing lights or digital screens.
- Individuals experiencing dizziness, severe migraines, or extreme neurological/sensory sensitivity to rapid stimuli.
- If, during use, you experience tremors, blurred vision, dizziness, muscle contractions, disorientation, or any other physical discomfort, stop use immediately and consult a physician.
4. Absolute Limitation of Liability
- Use of the Platform is undertaken at the sole, full, and voluntary risk of the user.
- The Platform's developers, owners, operators, or anyone acting on their behalf shall bear no liability for any direct, indirect, consequential, special, or punitive damage (including physical injury, health damage, neurological, sensory, or physical harm, headaches, or financial and business loss) sustained by the user or any third party as a result of using the Platform, relying on its content, or any technical failure or malfunction in accessing it.
- Should any competent authority determine that the developers bear any liability whatsoever, the maximum amount of liability and compensation owed to the user, on any grounds (contractual, tortious, or otherwise), shall be limited exclusively to the amount actually paid by the user for the relevant application's training stage.
5. Privacy Policy & Zero-Data Retention
- The Platform operates under a full privacy-by-design model. The system does not use central or external databases and does not save, collect, store, or process usernames, assessment results, or training scores on internet servers.
- All information, names, metrics, and scores are stored solely and locally in the browser memory of the user's personal device (local storage / cookies). The user acknowledges that clearing browsing history, browser cache, or switching devices will permanently delete this data and access permissions, and the developers have no access to or ability to recover it.
- Payment & Checkout Security: Every purchase of a training stage is processed, managed, and secured exclusively by authorized third-party payment providers under the strictest security standards (PCI-DSS). The Platform's developers have no access to, visibility of, or ability to store credit card details, bank accounts, or personal financial information belonging to the user.
- Sub-processors: To operate the Platform, the developers rely on external payment providers who process payment for the training stage and receive, for that purpose, the payment details the user enters on the checkout page (the developers do not see or store these details, as stated above).
6. Digital Purchase & No-Refunds Policy
- Each application's assessment stage is offered to the public free of charge and without any need for prior registration, so users can evaluate the application's suitability and performance on their device before making a payment.
- Access to the training stage requires a one-time payment as detailed on the checkout page. Because this involves the supply of a digital product, software, and immediate access to unique content that can be copied and reproduced (as recognized under consumer protection law and international digital commerce regulations), every purchase is final and absolute.
- No refunds (full or partial), transaction cancellations, exchanges, or credits will be issued for any reason after payment has been made and the exercises have been unlocked on the user's device.
7. Intellectual Property & Software Protection
- All copyrights, trademarks, source code (HTML, JavaScript, CSS), algorithms, stimulus exercises, logos, and designs within the NeuPractix platform and its applications belong exclusively to the Platform's developers.
- It is strictly prohibited to copy, duplicate, distribute, reverse engineer, modify, or use the system's code for any commercial or private purpose without the express written consent of the Platform's owners.
8. Governing Law & Jurisdiction
These terms of use, and any dispute or claim arising from use of the Platform, shall be governed exclusively by the laws of the State of Israel. Exclusive jurisdiction to hear any dispute shall be vested in the competent courts of the Central District, Israel.
